Overview
The amendments to the Occupational Safety and Health Act, which took effect as of January 2020, has expanded the scope of the parties responsible for the statutory compliance for workplace safety. In addition, the Serious Accident Punishment Act, which came into force in January 2022, places criminal liability for workplace accidents and occupational illnesses on the top management of companies. To effectively address this statutory move, Yoon & Yang’s Serious Accident Punishment Act Practice is comprised of more than 30 criminal defense lawyers, many of whom are former prosecutors holding central positions at the Public Security Department of the Prosecutors’ Office, and experts in various areas such as construction, employment and labor, product safety and internal investigations. The Practice offers integrated legal services, such as design and implementation of compliance systems, on-site investigations, root cause analysis and safety management. The Practice also represents clients in investigations by law enforcement agencies and legal proceedings relating to workplace safety.
